Legal terms for partners

Brand Asset Licence & Terms of Use

The licence under which invited partners use Freedom brand assets. Version 1.1 · 8 October 2026.

In one sentence: use these Assets, unchanged and with the approved wording, only to sell genuine Freedom Confectionery products as an independent stockist — never to present yourself as Freedom or an official Freedom channel.

1. About these terms

These Brand Asset Licence & Terms of Use (the “Terms”) govern access to the Freedom Media Centre (the “Portal”) and use of every logo, image, video, presentation, piece of copy, product data sheet, claim wording and other material made available through it (“Assets”). The Portal and the Assets are provided by Freedom Confectionery Limited, Brunel House, 9 Penrod Way, Heysham, LA3 2UZ, United Kingdom (“Freedom”, “we”, “us”).

Access is by invitation only. The Terms apply to every account holder — retailers, distributors, wholesalers, brokers, e-commerce and marketplace partners, foodservice operators and their directly engaged agencies (“you”) — and to the company you represent (your “Company”). By accepting the Terms when you activate or continue your account, or by downloading or using any Asset, you agree to them on behalf of yourself and your Company, and you confirm you have authority to do so.

2. The licence we grant you

While your account remains active, Freedom grants your Company a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to use the Assets solely to advertise, market and sell genuine Freedom Confectionery products that your Company stocks, distributes or lists, in the channels for which access was granted.

This includes use in retail listings and product pages, marketplace listings (for example Amazon or Walmart), online grocery platforms, social media posts and paid advertising, printed point-of-sale and trade materials, catalogues and buyer presentations — always in connection with genuine Freedom products.

Where a marketplace, retail platform or social network requires a licence to content you upload in order to display your listing or post, you may grant it that limited licence, solely for displaying your listings and posts for genuine Freedom products. This is the only sublicence permitted.

No ownership passes to you. All intellectual property in the Assets and in the Freedom name, logos and other marks remains with Freedom or its licensors, and all goodwill arising from your use accrues to Freedom. Any use outside this licence is unlicensed.

3. What you must not do

  • Use Assets to promote products that are not genuine Freedom Confectionery products, or in any way that suggests Freedom endorses another brand, product or service.
  • Sell, sublicense (except as section 2 allows for platforms), rent, publish as a library or otherwise redistribute Assets themselves.
  • Alter the Freedom logo or any certification mark — no recolouring, stretching, cropping, added effects or combining it into a new mark.
  • Use Assets in content that is misleading, unlawful, or inconsistent with Freedom's family-friendly, inclusive brand values.
  • Use Assets to train, fine-tune or prompt generative-AI models, or mint them in any tokenised form.
  • Register any Asset, the Freedom name or any confusingly similar sign as a trade mark, design, company name or domain name.
  • Continue using Assets after your access ends or after we ask you to stop (see section 10).

4. Representing your relationship with FreedomNew in 1.1

You must not present yourself or your Company as Freedom, or as Freedom's agent, official or exclusive distributor, franchisee, representative or partner, unless Freedom has agreed that status with your Company in a signed written agreement — and then only within the terms of that agreement.

Wherever you use the Assets, you must make clear that your Company is an independent business that stocks or sells Freedom products (for example “Freedom Confectionery products, sold by [your Company]”). Access to the Portal does not by itself create any partnership, agency, distribution or endorsement relationship.

You must not make statements on Freedom's behalf to customers, the press or regulators, or answer enquiries addressed to Freedom as if you were Freedom.

5. The Freedom name and marksNew in 1.1

You must not use the name “Freedom Confectionery”, “Freedom Mallows”, any other Freedom brand or product name, or any Freedom logo, mascot or other mark — or anything confusingly similar — in or as part of:

  • a company, business or trading name;
  • a website domain name or sub-domain;
  • a social-media account name, handle, page name or profile image;
  • an app name, or a store, shop or marketplace storefront name;
  • an advertising account name or profile.

You must not create any website, social-media account, page, profile, listing, advertisement or other channel that is designed to look like, or could reasonably be mistaken for, an official Freedom channel. Using the brand name to describe genuine Freedom products you sell (for example in a product title or listing) is permitted.

6. Logos, brand marks and clear space

Use logo files exactly as supplied. Keep clear space around the Freedom roundel at least equal to the height of the word “Freedom” within it, place it on backgrounds with sufficient contrast, and never over busy patterns. Minimum reproduction size: 20mm print / 72px digital.

Certification marks (for example The Vegan Society, Halal certification or B Corp) belong to their issuing bodies and carry their own rules. Use them only as supplied, only in connection with the Freedom products they certify, and follow any guidance attached to the download.

7. Claims — approved wording, word for word

Freedom is an allergen-focused brand; accuracy is a consumer-safety matter, not just a brand one. Only make the product claims published in the Portal, using the approved wording exactly as written, including any cautions.

In particular: allergen claims apply to the core marshmallow range only and must not be applied to the chocolate-coated range (which carries its own nut status) or extended to any product they don't cover; Kosher status is arranged production run by production run and must never be presented as a blanket claim; and PKU-related statements must be confirmed per SKU before use in dietary contexts.

You are responsible for ensuring your materials comply with the advertising, labelling and food-information laws of every market where they appear. If a claim in the Portal appears to conflict with local regulation in your market, stop and contact us before publishing.

8. Product data and imagery accuracy

Data sheets are provided in good faith to help you build listings. Fields marked “to be confirmed” are pending verification — do not guess them. Always reconcile pack copy, ingredients and allergen statements against the physical product or the latest specification supplied by Freedom before publishing.

Where an Asset shows a pack design, use the current version in the Portal and retire superseded pack imagery when we update it (version numbers are part of every file name).

9. Access is for your named Company onlyNew in 1.1

Portal access is granted to the Company named on your account and to you personally. Keep your login confidential and do not share accounts. You may share downloaded Assets within your Company, and with an agency directly engaged on your Company's Freedom marketing provided that agency is bound by these Terms — but with no one else.

Some Assets are private or restricted and are granted to a specific Company. These must not be shared outside that Company and its directly engaged agencies. Tell us promptly if you believe your account has been compromised, or if the person who holds it leaves your Company.

To protect the brand, the Portal records which account downloaded which Asset, when, and from which IP address, together with each acceptance of these Terms. Freedom may rely on these records as evidence of the licence granted and of how Assets were obtained.

10. Monitoring, audit and cooperationNew in 1.1

Freedom may monitor how and where Assets are used. On request, your Company will within five (5) business days tell us where and how it is using the Assets, provide copies or links to materials that use them, and confirm the removal of any material we ask to be taken down.

If Freedom investigates suspected misuse of the Assets, misrepresentation of a relationship with Freedom, counterfeit or passing-off activity, you and your Company will cooperate in good faith, including by providing relevant information and preserving relevant records.

11. Takedown, suspension and endingNew in 1.1

We may refuse, suspend or withdraw Portal access for any person or Company at our discretion, and may update or withdraw any Asset at any time.

Within 48 hours of our request you must remove any material that, in our reasonable opinion, misuses the Assets, misrepresents your relationship with Freedom, breaches sections 3, 4 or 5, or raises a safety, allergen or regulatory concern.

In any other case where your access ends or we withdraw a specific Asset, you must stop creating new materials with the affected Assets and remove them from digital channels you control within 30 days. Printed materials already in circulation may be run down over a reasonable period unless the 48-hour rule above applies.

12. IndemnityNew in 1.1

Your Company will indemnify Freedom against all losses, damages, liabilities, costs and expenses (including reasonable legal fees) that Freedom suffers or incurs as a result of any breach of these Terms by you, your Company or its agencies, any unlicensed use of the Assets, any misrepresentation of a relationship with Freedom, or any materials you create using the Assets.

13. Privacy

To manage the Portal we process the business contact details you provide (name, work email, Company, country, engagement type and your stated reason for access), together with records of invitations, approvals, licence acceptances, downloads (date, time and IP address), requests and support conversations. We use this information to operate the Portal, decide on access, provide support, keep Assets secure and enforce these Terms. It is processed in line with UK GDPR and is not sold to third parties.

Freedom is the controller of this data. The Portal is operated for Freedom by LOOM Brand Designs, which processes the data on Freedom's behalf. To exercise your data rights, contact support@loombranddesigns.com.

14. No warranty; liability

Assets are provided “as is”. To the fullest extent permitted by law, Freedom excludes all implied warranties and is not liable for any indirect or consequential loss arising from Portal or Asset use. Nothing in these Terms limits liability that cannot lawfully be limited. You remain responsible for your own marketing materials and their compliance.

15. Changes to these TermsNew in 1.1

Each version of these Terms carries a version number and date. When we make a material change, we will ask you to accept the new version in the Portal before you can continue to use it, and we keep a record of each acceptance. Assets downloaded before a change remain subject to the version in force at the time unless the new version says otherwise.

16. General

These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, save that Freedom may seek urgent injunctive relief in any jurisdiction where misuse occurs. If any part of these Terms is found unenforceable, the rest remains in force. Freedom's failure to enforce a provision is not a waiver of it. These Terms do not affect any separate written agreement between Freedom and your Company, which prevails if the two conflict.

Version 1.1 · 8 October 2026. Replaces the Content Use Policy (version 1.0, 4 August 2026). Partners are asked to accept each new version in the portal before continuing.
